Terms of Service

These terms are the agreement between you and the operator of eSign Me. By using the app or this website, you accept them. If you don't accept them, don't use the service.

What eSign Me does

eSign Me lets you scan a document with your iPhone, capture a handwritten signature, place it on a PDF, and send the document to another person so they can sign it in their browser. How we handle the data involved is described in our Privacy Policy.

What eSign Me is not

It does not verify who signed. A signature made with eSign Me is a simple electronic signature. We do not check the identity of the person who signs, we do not issue an audit trail or a certificate of completion you could rely on as evidence, and we do not add tamper-evident protection to the file. We cannot confirm that a document was signed by the person you sent it to, and we make no claim about how much weight a court or an authority would give it.

Some documents cannot be signed electronically at all. In many countries, including under the United States ESIGN Act and UETA, electronic signatures are excluded by law for certain documents, no matter which service is used. These typically include:

  • wills, testamentary trusts and other testamentary instruments;
  • family law matters such as divorce, adoption and marriage;
  • court orders, notices and official court documents;
  • notices of eviction, foreclosure, repossession, or termination of utility services;
  • product recalls affecting health or safety.

Some documents require a notary. A notarial act is a separate legal requirement that no electronic signature replaces: real estate deeds and mortgages, powers of attorney, affidavits and sworn statements, and anything that has to be apostilled or registered with a public authority.

Do not use eSign Me for these documents. Use a notary, a qualified electronic signature provider, or paper, as your situation requires. If you are unsure whether a document can be signed electronically where you live, get legal advice before you sign — this page is not legal advice.

Using the service

You must be at least 13 years old to use eSign Me, or at least 16 if you are in the European Economic Area or the United Kingdom.

You may use eSign Me only for lawful purposes. You must not:

  • upload or send documents you have no right to use;
  • impersonate another person, or ask someone to sign under a false identity;
  • use the service to send unsolicited documents in bulk;
  • attempt to access documents, links or accounts that are not yours;
  • interfere with the service, probe it for vulnerabilities, or use it to distribute malware;
  • extract data from the service to build a competing product.

We may suspend or block access to the service if it is used in these ways.

Your responsibility

For the documents. You are responsible for what you upload and send, for having the right to do so, and for the content being lawful.

For the recipient. We don't verify that an email address belongs to the person you intend to reach, and we don't confirm anyone's identity. Anyone holding a signing link can open the document — keep the link confidential and send it only to the person who should sign.

For your copies. Documents are removed from our servers on the schedule in the Privacy Policy. We are not a storage service and not your archive: keep your own copy of anything you need to retain.

Availability

We provide the service as it is, without any promise that it will be available, uninterrupted, or free of errors, and we may change, suspend or discontinue any part of it. We may also change these terms; if we do, we will update the date at the top of this page, and where the change is significant we will say so in the app.

No warranties

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that a document signed through the service will be accepted or enforceable in any particular situation.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, business, or goodwill, arising from your use of the service — including any loss arising from a document being rejected, disputed, lost, altered, or seen by someone who obtained a signing link.

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, for death or personal injury caused by negligence, or the mandatory rights of consumers.

Apps downloaded from the App Store

If you obtained eSign Me from the Apple App Store, the following applies:

  • These terms are between you and the operator of eSign Me only, not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • The operator of eSign Me, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to a legal requirement, and claims arising under consumer protection or similar legislation.
  • The operator of eSign Me, not Apple, is responsible for the investigation, defense, settlement and discharge of any third-party claim that the app infringes that party's intellectual property rights.
  • You confirm that you are not located in a country subject to a U.S. Government embargo, or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the law of the Republic of Armenia, and disputes will be handled by the courts of the Republic of Armenia.

This does not deprive you of the protection of the mandatory consumer laws of the country where you live. If you are a consumer in the European Economic Area or the United Kingdom, you keep the rights those laws give you, including the right to bring proceedings in your own courts.
